When FDR was president, he signed Social Security (SSI) into law and the supreme court upheld it. FDR had first sent his labor secretary, Francis Perkins, to ask a supreme court justice how to make SSI able to withstand a court challenge. The justice told Perkins the federal government had the power to tax, and that SSI would withstand a legal challenge on that basis. And it did.
This lesson was lost on President Obama. The federal government can not order people or organizations to purchase health insurance anymore than it can order people to buy ketchup. I’m not a lawyer, but anybody with half a brain can see this. Although I disagree, there are some legal experts that think Obamacare can withstand a court challenge.
